Terms of Service

These terms govern your use of Turbyn. By creating a workspace or using the service, you agree to them.
The service
Turbyn lets you write code and run it as an action inside HubSpot workflows. We provide the runtime, the editor, execution history and the integration with HubSpot’s automation platform.
We are not affiliated with, endorsed by or sponsored by HubSpot, Inc. Your use of HubSpot is governed by your agreement with them. Changes HubSpot makes to their platform may affect how this service works, and some are outside our control.
Your account
You are responsible for your account credentials, for the actions of anyone you invite to your workspace, and for the OAuth authorisations you grant. Tell us promptly if you believe an account has been compromised.
You must be able to form a binding contract to use the service.
Your code and your data
You own the code you write and the data it processes. We claim no rights in either beyond what is needed to operate the service: storing your code so it can be executed, and processing CRM data on your instruction when an action runs.
You are responsible for what your code does. It runs with the OAuth permissions you granted, and it can create, modify and delete records in your CRM. Test against a record you are willing to change before you publish.
Acceptable use
You may not use the service to:
- break the law or infringe someone else’s rights;
- attempt to escape the execution sandbox, reach other customers’ data, or probe our infrastructure beyond your own workspace;
- mine cryptocurrency, or run workloads unrelated to CRM automation;
- send unsolicited bulk messages;
- deliberately circumvent plan limits, or degrade the service for other customers.
If you breach these terms we may suspend the affected workspace. Except where the breach is causing active harm, we will contact you first and give you a reasonable opportunity to fix it. Repeated or deliberate breach may result in termination.
Plans, billing and limits
Plans carry published limits on run volume, runtime and memory. Current plans and limits are on the pricing page.
Exceeding your run allowance triggers a notification rather than an immediate stop. We would rather tell you than break a live automation. Sustained overage means it is time to move up a plan, and we will discuss that with you before taking any other action.
Paid plans bill monthly in advance. Plan changes are prorated. Fees are exclusive of any applicable taxes, which you are responsible for. Payments are non-refundable except where required by law, though we will not be unreasonable if something has plainly gone wrong.
We will give at least 30 days’ notice by email before any price increase takes effect.
Availability
We aim to keep the service running continuously and will give advance notice of planned maintenance where we reasonably can.
We do not currently offer a contractual uptime commitment. When we do, it will be published with a defined measurement method and a service-credit mechanism rather than stated as a number here.
Termination
You can close your workspace at any time. On closure your actions stop running, which will affect any HubSpot workflow that depends on them. Remove those steps from your workflows before closing.
You can export your code and run history before closing. After closure, data is deleted on the schedule in the privacy policy.
We may terminate for material breach of these terms, or with 30 days’ notice if we discontinue the service, in which case we will refund any prepaid fees covering the period after termination.
Warranties and liability
The service is provided “as is”. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Two things are worth stating plainly, because this service executes your code against your CRM:
- We are not liable for what your code does. If an action deletes or corrupts records, that is a consequence of the code you published and the permissions you granted.
- We are not liable for indirect, incidental or consequential loss, including lost profits, lost revenue or lost data.
Our total aggregate liability arising out of or relating to the service is limited to the greater of the fees you paid in the twelve months before the claim, or one hundred US dollars.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Indemnity
You will indemnify us against third-party claims arising from your code, your data, or your use of the service in breach of these terms.
Changes to these terms
If these terms change materially we will email workspace owners at least 30 days before the change takes effect. Continuing to use the service after that means you accept the change. If you do not, you may close your workspace and receive a refund of any prepaid fees for the remaining period.
General
If any provision is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor in connection with a merger or acquisition.
